The Austrian authorities are very particular about work documents: This one mistake can cost you EUR 20,000!

Planning to work in Austria and want to avoid heavy fines? Then this article is just for you! It is not enough to comply with your reporting obligations to the local authorities. It is also important to have all the necessary documents ready and to be able to produce them immediately in the event of an inspection.

The authorities there are uncompromising when it comes to checking the obligations of foreign workers in Austria. More than one Slovak company has already paid the price for not paying enough attention to its duties and not consulting experts in advance.

Austrian conditions

As a company seconding workers to Austria, the first step you need to take is to report them to the relevant authorities using the ZKO form. This informs the authorities of the presence of your employees on Austrian territory.

Of course, there are many more documents that you need. These include, for example, an A1 form from our Social Insurance Office, an employment contract with a secondment agreement, pay slips, or payroll records showing the composition of remuneration and allowances. When seconding employees to Austria, you must ensure that their wages comply with the local sector-specific wage regulations.

On-site inspection of works

You must have all the necessary documents available on paper or electronically and be able to produce them immediately if an inspection comes. Otherwise, your contract in Austria may cost you several thousand Euros more.

This is how a fine of EUR 6,000 was recently imposed on a Slovak company on the grounds that the required documents were not immediately available at the notified construction site, but remained at the hostel and were thus submitted late for inspection. Quite an expensive oblivion, and they still got around that quite well! The fine for not having your documents available at the reported location can be up to €20,000. In a repeated case, it can reach up to €40,000!
